Cybin Enterprises is a payment solutions consultant. We are NOT a bank, financial institution, lender, or payment processor. We do not provide loans, funding, or financial services. We connect businesses with third-party payment processors and acquiring banks.
Acceptance of Terms
By accessing and using the Cybin Enterprises website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
Description of Service
Cybin Enterprises provides payment processing consultation services. We:
- Connect businesses with payment processors and acquiring banks
- Provide consultation on payment processing solutions
- Facilitate introductions to our partner network
- Offer guidance on application processes
We do NOT:
- Process payments or handle funds
- Make approval decisions (decisions are made by processors/banks)
- Provide loans, funding, or financial services
- Guarantee approval or specific rates/terms
- Act as a bank or financial institution
Eligibility
To use our services, you must:
- Be at least 18 years old
- Have legal authority to bind your business to agreements
- Provide accurate and complete information
- Operate a legitimate business in compliance with applicable laws
Your Responsibilities
You agree to:
- Provide accurate, current, and complete information in your application
- Disclose your industry, business model, and processing history honestly
- Maintain the confidentiality of your account information
- Notify us of any unauthorized use of your information
- Comply with all applicable laws and regulations
- Use our services only for lawful purposes
No Guarantees
We do not guarantee:
- Approval by any payment processor or acquiring bank
- Specific rates, terms, or conditions
- Processing timelines or approval speeds
- That any particular processor will accept your application
Final approval decisions are made solely by payment processors and acquiring banks. We facilitate introductions but have no control over underwriting decisions.
Fees and Compensation
Our Services
Our consultation and matching services are free to you. We receive compensation from our processor partners when you choose to work with them.
Processor Fees
Payment processors charge fees directly to you. These may include:
- Discount rates (percentage of each transaction)
- Per-transaction fees
- Monthly statement and gateway fees
- Reserve requirements (percentage held as security)
- Setup fees, termination fees, and other charges
Third-Party Services
Our services involve introductions to third-party payment processors and acquiring banks. These relationships are governed by separate agreements between you and the processor.
We are not responsible for:
- The acts or omissions of payment processors
- Processor terms, rates, or policies
- Disputes between you and processors
- Processor service quality or reliability
Limitation of Liability
To the maximum extent permitted by law, Cybin Enterprises shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or business opportunities
- Business interruption or downtime
- Account terminations by processors
- Funds held or reserves imposed by processors
- Chargebacks or fraud losses
Our total liability shall not exceed the amount we received from you (if any) in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Cybin Enterprises from any claims, damages, losses, or expenses arising from your use of our services, your violation of these terms, or your violation of any laws or third-party rights.
Termination
We reserve the right to terminate or suspend your access to our services at our sole discretion, without notice, for conduct that we believe violates these terms or is harmful to us or others.
You may stop using our services at any time.
Governing Law
These terms shall be governed by the laws of the United States, without regard to conflict of law provisions. Any disputes shall be resolved in the federal or state courts located in the United States.
